UBA holds discussion on current issues of mobilization and employee reservation

The pressing issues of mobilization and employee reservation were discussed at the Ukrainian Bar Association on Tuesday, September 17. The event was organized by four UBA Committees: Committee on Military Law, Military Justice, and Veterans' Rights; Committee on Labor Law; Committee on Sports Law; and Committee on Agricultural Law.

The first part of the discussion focused on the status of critical enterprises and the reservation of employees. The speakers were:

  • Anastasiia Didenko, Deputy Chair of the UBA Committee on Military Law, Military Justice, and Veterans' Rights, Counsel at LCF Law Group;
  • Vitalii Melyankov, Senior Lawyer at Vasyl Kisil and Partners;
  • Oleksii Ozvynchuk, Lawyer at Vasyl Kisil and Partners;
  • Oleksii Voznyi, Deputy Director of the Security and Defense Economics Department — Head of the Mobilization Preparation Division at the Ministry of Economy of Ukraine.

The second session addressed the challenge of finding a balance between mobilizing and reserving athletes. Participants debated how to interpret the current criteria for reserving athletes and whether they require changes.

The session also delved into issues arising during the reservation process and explored possible improvements to the procedure, with special attention to updating military registration data for athletes, a category with unique requirements.

The experts for this session were:

  • Yevhenii Promskyi, Chair of the UBA Committee on Sports Law, Lawyer at ARES Law Firm;
  • Hanna Gnizdovska, Board Member of the UBA Committee on Sports Law, Head at Juris Ferrum Law Firm.

The third part of the event discussed the reservation of employees in the agricultural sector, with a particular focus on the process of obtaining critical enterprise status and reserving employees for agricultural companies in light of recent legislative changes. Participants highlighted key challenges faced by agricultural enterprises during the reservation process and explored potential solutions.

The speakers in this session were:

  • Svitlana Teterya, Chair of the UBA Committee on Agricultural Law, Counsel at EVERLEGAL;
  • Artem Filipiev, Director of Legal Support at Kernel;
  • Yuliia Babenko, Acting Head of the Mobilization Department at the Ministry of Agrarian Policy and Food of Ukraine;
  • Taras Vysotskyi, First Deputy Minister of Agrarian Policy and Food of Ukraine.

The event served as a platform for experience exchange and generating proposals to improve the reservation and mobilization procedures across various sectors, a topic of particular relevance today.
