The Trial Monitoring in War Crimes Cases
The Ukrainian Bar Association (the “UBA”) is implementing "The Trial Monitoring in War Crimes Cases" project within the framework of a grant agreement with the USAID Human Rights in Action Program, administered by the Ukrainian Helsinki Human Rights Union (UHHRU).
With the onset of the full-scale war, Ukraine's justice system faced the urgent need to efficiently process a large volume of cases involving war crimes and crimes against humanity. Monitoring proceedings related to serious international crimes is a critical step in supporting the Ukrainian justice system’s commitment to ensuring fair trial rights and advancing Ukraine’s European and Euro-Atlantic integration.
The objectives of the "Monitoring of War Crimes Proceedings" project are to:
- Analyze new judicial practices in Ukraine related to war crime cases, including the role of prosecution bodies and the quality of defense provided to suspects, defendants, and victims;
- Assess to what extent such judicial practices meet international standards, particularly human rights standards;
- Identify any deficiencies, if found, to bring them to the attention of the judiciary and develop recommendations for their correction.
Given the unprecedented demands on the judicial system and the lack of deep expertise in war crimes among judges and judicial staff across all regions of Ukraine, monitoring judicial proceedings will also assist in promptly addressing any shortcomings in judicial practices.
