Virtual Discussion Held on Legal Mechanisms for Business Protection
On April 28, 2025, the Ukrainian Bar Association’s Committee on International Law hosted an online discussion titled “Staying Ahead of the Game | Let’s Talk Due Diligence and Protective Mechanisms.”
This virtual coffee-format event brought together lawyers, entrepreneurs, advisors, and international business professionals committed to managing risks effectively in dealings with both Ukrainian and foreign partners.
The speakers included Olga Kuchmienko, Chair of the Committee, attorney at law and PhD in Law, and Viktoriia Ivasechko, Committee Board Member and Counsel at Redcliffe Partners. They shared practical approaches to counterparty due diligence in today’s environment, where insufficient checks or a weak contractual framework can lead to significant legal and financial exposure.
Key topics included modern methods of pre-contractual screening of counterparties—particularly in high-risk jurisdictions—contractual structuring as a tool to mitigate uncertainty, and the importance of building an evidentiary foundation from the outset of business engagement. Particular attention was given to identifying early signs of potential disputes and steps to take when a commercial relationship begins to show signs of instability.
The participants discussed typical mistakes to avoid when concluding contracts, shared case studies from practice, and emphasized the need for close cooperation between lawyers and business to ensure the legal stability of partnerships.
The event was conducted in an open, professional atmosphere, once again underscoring the importance of experience-sharing among legal practitioners working at the intersection of Ukrainian and international law.
