Recovery of damages in commodity arbitrations: Discussion of the new rules

The UBA Committee on Alternative Dispute Resolution held an online event on “New rules for recovery of damages in commodity arbitrations”

On March 4, 2025, the UBA Committee on Alternative Dispute Resolution held an online event dedicated to the current issues of damages in commodity arbitrations.

The event was moderated by Iryna Moroz, Partner at AGA Partners, Deputy Chairman of the UBA Committee on Alternative Dispute Resolution.

The speakers were:

- Pavlo Lebedev, Counsel at AGA Partners, Deputy Chairman of the UBA Committee on Agrarian Law, PhD student at Yaroslav Mudryi National Law University.

- Viktor Pasichnyk, Associate at AGA Partners, Member of the Board of the UBA Committee on Agrarian Law, PhD student at the V.M. Koretsky Institute of State and Law.

- Vasyl Radetskyi, Associate at AGA Partners, PhD student at the Institute of Lawmaking and Scientific and Legal Expertise of the National Academy of Sciences of Ukraine.

During the event, the participants discussed key aspects of compensation for damages in commodity arbitrations, including changes to the rules for assessing damages in agricultural arbitrations, determining the date of default and the amount of damages, as well as practical approaches to fixing damages in cases of buyer's rejection of the goods. The speakers analyzed court cases and arbitral awards illustrating the current practice and trends in international arbitration.

The event was characterized by a high level of professional discussion and interest of the participants, which demonstrates the relevance of the topic for the legal community.
