UBA held a discussion on practical issues of recognition and enforcement of foreign court judgments and international arbitral awards in Ukraine

On Thursday, July 25, the UBA Committee on Alternative Dispute Resolution held the event "Practical Issues of Recognition and Enforcement of Foreign Court Judgments and International Arbitral Awards in Ukraine".

The discussion was moderated by Iryna Moroz, Deputy Chair of the UBA Committee on Alternative Dispute Resolution, Partner at AGA Partners, attorney at law.

The speakers of the event were:

  • Oleksandr Zub, Associate at AGA Partners;
  • Olga Kostyshyna, Counsel at LCF Law Group;
  • Iryna Falovska, judge of the Civil Court of Cassation of the Supreme Court;
  • Maksym Fesenko, Associate at AGA Partners.

In particular, the panelists discussed the issue of invalidation of an arbitration agreement in the process of recognizing and enforcing an international commercial arbitration award.

In addition, attention was paid to the peculiarities of recognition and enforcement of foreign court awards and international arbitral awards with a sanction element. In today's international politics, when sanctions are becoming an increasingly common tool, it is important to understand how these restrictions can affect the law enforcement process.

The participants of the event also reviewed the current judicial practice of setting aside awards of the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry (the ICAC).
