Judgment Inflation: UBA Judges’ Section Gathers Legal Experts to Seek Solutions
On May 3, 2025, a professional event titled “Judgment Inflation: Causes, Consequences, and Remedies” took place in Kyiv. It was organized by the UBA Judges’ Section, in cooperation with the Legal Association “DOBROSUD” and the Serhiy Nyzhny School of Public Administration.
The event featured three thematic panels exploring the complex issue of the devaluation of judicial decisions—its causes, manifestations, and systemic implications. Participants also discussed methods to counteract the phenomenon, the role of judicial activism and trial-level procedural tools, as well as the effectiveness of cassation review in ensuring the consistency of case law.
Panelists included judges from various levels and regions:
- Oleksandr Harskyi, Judge of the Malynivskyi District Court of Odesa (online)
- Sergiy Gryshko, Chair of the UBA Committee on Procedural Law, Attorney at law
- Dmytro Hudyma, Judge of the Supreme Court, Chair of the UBA Judges’ Section
- Olena Kibenko, Judge of the Supreme Court, Member of the UBA Board
- Taras Kotormus, Judge of the Kamianka-Buzka District Court, Lviv Region
- Vasyl Krat, Judge of the Supreme Court
- Dmytro Tkachenko, Presiding Judge of the Boryspil City District Court, Board Member of “DOBROSUD”
- Ihor Shevyakov, Deputy Head of the Poltava District Administrative Court
- Victor Yatsyna, Judge of the Kharkiv Court of Appeal (online)
The event was moderated by Tetiana Ognev’iuk, Chair of “DOBROSUD,” attorney at law, partner at AMBASSADORS Dispute Resolution Practice.
Key questions discussed:
- Does a significantly delayed judgment lose its value?
- What is the role of judicial activism in ensuring effective legal protection?
- Have cassation filters become a barrier to access to justice?
- How does the lack of an efficient search function in the Unified State Register of Court Decisions affect legal certainty?
The event became an important platform for professional dialogue on strengthening the authority of the judiciary and preserving the value of judicial decisions as a cornerstone of rights protection.
