UBA Committee Supports Bills on Intellectual Property Rights of Military Personnel

The UBA Committee on Intellectual Property has appealed to the Verkhovna Rada of Ukraine's Committee on Legal Policy and the Committee on Economic Development, expressing support for Draft Bills No. 13110 and No. 13111, registered in the Verkhovna Rada on March 17, 2025. These initiatives aim to amend the legislation regarding property rights to intellectual property created by military personnel while performing official duties.

Currently, there is a legal uncertainty as existing legislation does not address the intellectual property rights of military personnel, even when their creation is part of official assignments. The draft laws propose a solution to this problem: personal non-property rights to intellectual property remain with the creator (the military personnel), while property rights are transferred to the state, represented by the relevant bodies of the security and defense sector. This solution is both logical and justified, as it allows for the effective use of intellectual creations to strengthen the country's defense capabilities.

Moreover, including such rights as part of military property and clarifying the authorities responsible for managing these rights is an essential step to ensure national security and the efficient use of scientific developments in the military sector. This will enable more organized and centralized management of intellectual assets resulting from military service, which is particularly relevant in the current war context.

The UBA Committee supports these draft laws, as their adoption would allow for the effective use of intellectual developments in the security and defense sectors, which is critically important for strengthening Ukraine’s defense capabilities. Given the current challenges of war, these changes will help ensure national security and the effective protection of state interests. Committee representatives emphasize the need for the Verkhovna Rada to consider these Draft Bills as soon as possible, as legislative changes in the field of intellectual property rights for military personnel are crucial for maintaining the stability of the legal system and the security of the state.
