International Standards of Liability of Legal Entities for Corruption Offenses: Challenges and Prospects for Implementation in Ukraine

On February 6, a professional event “International Standards of Liability of Legal Entities for Corruption Offenses: Challenges and Prospects for Implementation in Ukraine” was held. The event was organized by the UBA Compliance Committee, the UBA Committee on Criminal and Criminal Procedural Law, and the UBA Committee on Tax and Customs Law.

During the event, the experts discussed key aspects of the Law of Ukraine No. 4111-IX dated 04.12.2024 on improving the mechanisms for bringing legal entities to justice for bribery of foreign officials. In particular, the following were considered:

- main provisions and innovations of the law;

- compliance of Law No. 4111-IX with OECD standards.

The international experience of bringing legal entities to liability for corruption and the realities of its implementation in Ukraine were also highlighted. Particular attention was paid to the temporary restriction of legal entities and special confiscation as a mechanism for combating corruption.

A separate block of discussion was devoted to the implementation of compliance obligations in business. Experts discussed compliance as an effective tool for preventing corruption and shared practical cases of implementing anti-corruption programs in companies.

The event was moderated by Tetyana Lysovets, Vice President of the Ukrainian Bar Association, Senior Partner at Sokolovskyi and Partners.

Among the speakers were:

- Lana Sinichkina, Partner at Arzinger;

- Artem Krykun-Trush, Partner and Head of White-Collar Crime, Compliance and Investigations at Miller Law Firm, Member of the UBA Committee on Criminal and Criminal Procedural Law;

- Sergii Boiko, Member of the Board of the UBA Committee on Criminal and Criminal Procedural Law, Counsel at VB PARTNERS;

- Victoria Karpets, Manager of the EBA Industrial Ecology and Sustainable Development Committee.

The event has become an important platform for discussing current challenges and prospects for the implementation of international standards of liability of legal entities in Ukraine.
