UBA Alternative Dispute Resolution Committee invites you to attend the UBA webinar on "Bunkruptcy and Arbitration”, which will be held on 28 May 2025.
During the event, speakers will address issues related to initiating and conducting arbitration against a company undergoing bankruptcy proceedings, the impact of bankruptcy proceedings on existing arbitration, and the recognition and enforcement of arbitral awards against insolvent companies.
The speakers will review the impact of bankruptcy proceedings on arbitration in Ukraine, England, Cyprus, and Switzerland.
Initiating and conducting arbitration against a debtor who is in the process of bankruptcy:
- Does the debtor’s bankruptcy obstruct the commencement of the arbitration?
- Consequences of the commencement of the bankruptcy proceedings by the debtor in the course of arbitration.
Enforcement of the arbitral award against the debtor who is in the process of bankruptcy:
- Can the risk of insolvency or the bankruptcy proceedings be a ground for refusal to recognise and enforce the arbitral award?
- Recognition of creditor claims confirmed by an arbitration award in bankruptcy proceedings.
