The Telecom, IT & Internet Law committee invite you to join the UKRAINIAN CYBER WARFARE LECTURE «COMBATTING CYBER WARFARE: THE LEGAL AND TECHNOLOGICAL  CHALLENGES», which will attend on November 28, 2022, at 18.30 (Kyiv time).

DRAFT OUTLINE OF TOPICS

1. Introduction – General Overview

  • The growing importance of cyber warfare and espionage – combating state aggression, rogue nations and their activities, as well as the role of organised crime groups/professional hackers
  • The challenges posed to governments and legal systems and how to address them – the protection of state security secrets, public infrastructure projects, weapon and energy security
  • Increased awareness by the state to prevent, detect and respond to cyber-attacks and to utilise and deploy appropriate cybersecurity professionals
  • Existing cyber security structures and legal concepts used to address and combat these issues - are they fit for purpose?

 2. Challenges to the national state and justice systems

  • Cross jurisdictional and disclosure challenges to law enforcement and state agencies and the impact on criminal investigations and prosecutions
  • The lack of political will and resources to combat this issue on a national and supranational level
  • The absence of a coherent code of international law governing the actions of states and individuals operating in the cyber world and the difficulties that it causes 

 3. Proposed solutions to the challenges faced by cyber practitioners

  • Raise political, economic and legal awareness of the issues surrounding cyber warfare and espionage and the consequences to the nation-state, organisations and individuals
  • Governments and organisations to prioritise actions to ensure safeguards are deployed. The preventative measures need to be both holistic and in-depth to avoid leaving obvious areas of exposure
  • Development of a system of international law to regulate cybercrime, warfare and espionage, including a specialised international court to enforce the law
  • Increase cooperation between cyber security experts, law enforcement agencies and the criminal justice systems 

Speakers:

Ian Whitehurst, barrister, Guernica 37

Ian has over 25 years experience at the Bar specialising in serious organised crime, financial crime, confiscation and asset recovery as well as cybercrime. He prosecutes and defends and has substantial experience in cases involving complex international tax fraud, asset recovery in multiple jurisdictions, covert surveillance, interception of communications and cross jurisdictional investigations. He has been ranked now for several years in the leading legal directories as a Leading Counsel in the areas of crime, financial crime, confiscation, business crime and regulatory work.

Mark Potkewitz is an American attorney and former Director of the Legal Innovation Centre at Ulster University in Belfast, Northern Ireland.  He currently serves as and Adjunct Professor at Brooklyn Law School and General Counsel of ForHumanity, a US non-profit focused on independent Audit of AI and Autonomous Systems.

Steven Furnell, Professor of Cyber Security, University of Nottingham

Steven Furnell is a professor of cyber security at the University of Nottingham in the United Kingdom. He is also an Adjunct Professor at Edith Cowan University in Western Australia and an Honorary Professor at Nelson Mandela University in South Africa. His research interests include usability of security and privacy, security management and culture, and technologies for user authentication and intrusion detection.
