For the last 40 years the worldwide freezing order (“WFO”), being an interim measure issued by the English court, has been one of the most effective ways ensuring execution of the Court/Arbitral award by restraining a party (“Respondent”) from removing his assets from England and Wales or disposing of, dealing with or diminishing the value of assets located outside England & Wales up to a specified value.
Whereas, garnishee order, being a much “younger” interim injunction (now called “third party debt orders”) is a measure issued by the Court with respect to enforcement of a Court judgment whereby a judgment creditor (e.g. financier) can recover money owed by a judgment debtor (e.g. client or its customers) directly from a third party who is either holding money for the judgment debtor (usually a bank or building society) or who owes the judgment debtor an amount of money for whatever reason.
Thus, due to the reason that the WFO has been recently numerously issued against Ukrainian persons, the question of analysis of the requirements, conditions and consequences of granting the WFO is crucial. In addition, the procedure, benefits and effects of issuing the TPDO will be considered as well.
