Public procurement systems of Ukraine and EU: features of regulation and opportunities for business
On December 15, 2022, an online meeting of the UBA Young Lawyers’ Forum was held under the moderation of Mykyta Zhukov, CEO at ZHUKOV LEGAL FAMILY OFFICE, Chairman of the UBA Committee on Constitutional Law, Administrative Law and Human Rights, coordinator of UBA Young Lawyers’ Forum.
The event focused on Ukrainian and EU markets of public procurements, as well as opportunities for Ukrainian companies to take part in EU tenders and vice versa.
Speakers at online meeting were:
Philip Lee, partner at Philip Lee LLP, leading expert in the area of procurement, competition, trade, and construction law (Republic of Ireland).
Rebecca Carter, partner at Stephenson Harwood LLP, specializing in public procurement law in the UK (United Kingdom).
Serhii Sokorenko, project manager at Newtend (authorized electronic platform) (Ukraine).
Anna Szymanska, partner at Dentons, co-leading of public procurement practice and the member of the Public Procurement Council at the President of the Polish Public Procurement Office (Poland).
Ernad Deni Comaga, consultant for Public Procurement at IMTB Consulting GmbH (Germany).
Today Ukraine is experiencing difficult times related to the military aggression of the Russian Federation. However, public procurements in our country still proceed to exist and for European companies Ukraine still remains an interesting country for participation in local procurement. This is facilitated by the fact that the Ukrainian legislative base in the field of public procurement has similar features with the EU one.
At the same time, today Ukrainian business tries to expand the geography of activities and is interested in new markets like EU countries and the United Kingdom, particularly procurement systems of these countries.
During the event, attention was paid to the peculiarities of the public procurement systems of Ukraine, UK, Ireland, Poland and Germany.
Serhiy Sokorenko spoke about the Ukrainian public procurement system Prozorro and the authorized electronic platform Newtend, which has been working in this system almost since its launch (PRESENTATION).
Philip Lee shared information about the legislative base of the procurement system and the peculiarities of procurement procedures in Ireland (PRESENTATION).
Rebecca Carter spoke about the possibilities of the British public procurement market for Ukrainian business and its features in the "post-Brexit" era (PRESENTATION).
Anna Szymanska presented a report on the legislative base of the Polish public procurement system, procurement procedures, size of the Polish procurement market and opportunities for Ukrainian companies (PRESENTATION).
Ernad Deni Comaga spoke about the peculiarities of the public procurement regulation in Germany and the local procurement market prospects for Ukrainian business. In particular, Mr. Comaga expressed the opinion that the public procurement systems both of Germany and of EU in general should go more into automatization and digitalization.
"That must happen because the volume of public procurement is growing, we have more and more to be procured… And I guess that the corruption can go much lower if we do some automatization on the process of public procurement," the expert emphasized.
