EVERLEGAL successfully defended the interests of an international company in a domain dispute in the .UA domain

The international company, a leader in the international market for modern office furniture, has been selling its products in Ukraine for a long time. However, it became a victim of cybersquatting: the dishonest registration and use of a domain name by third parties, consisting of the name of the trademark owned by the international company.

The complexity of the situation arose from the full-scale invasion of the Russian Federation into Ukrainian territory, during which WIPO suspended the acceptance of new applications for the resolution of domain disputes in the .UA domain without specifying the time frames for such restrictions. This raised doubts about the possibility of filing such an application until the cessation or cancellation of the state of war in Ukraine. However, as of July 1, 2023, WIPO resumed providing services for the resolution of disputes regarding domain names and accepted our complaint regarding the disputed domain name.

The EVERLEGAL team provided full legal support to the client in a domain dispute at the WIPO Arbitration and Mediation Center and took all necessary actions to ensure the re-registration of the disputed domain name in the name of the client - the trademark owner. This will prevent any dishonest use of this domain name by any third parties in the future.

The project was handled by the EVERLEGAL Intellectual Property Practice team led by its head, Senior Associate Yuliia Vorontsova.
