Asters proves Russia’s liability for the nationalization of Ukrainian assets worth over USD 27 mln in Belarus

Asters, General Partner of the UBA, has successfully represented one of the largest manufacturers of welding products in Europe and Central Asia in a dispute against the Russian Federation regarding compensation for damages suffered by the client due to the nationalization of its subsidiary by the authorities of the Republic of Belarus following the onset of the full-scale invasion.

During the initial proceedings, the courts of first instance and appeal dismissed the claim, finding no grounds to hold the Russian Federation liable for the actions of the Belarusian government.

However, the firm’s attorneys secured a victory before the Supreme Court and obtained a retrial in which they demonstrated that the hostile actions of the Belarusian leadership towards Ukrainian businesses were part of a broader act of aggression by the Russian Federation against Ukraine.

As a result, the Commercial Court of Kyiv fully upheld the claim, ordering the recovery of over USD 27 million.
