UBA joins a roundtable discussion on "Rule of Law: Protecting Business in Tax Disputes"
On Friday, September 20, the Business Ombudsman Council of Ukraine (BOC) hosted a roundtable discussion titled “Rule of Law: Protecting Business in Tax Disputes.” The event brought together representatives from the BOC, State Tax Service of Ukraine, Prosecutor General's Office, Supreme Court judges, as well as members of the legal and business communities.
Among the key speakers was Oleksiy Bonyuk, Head of the Department for Criminal Law Policy and Investment Protection at the Prosecutor General's Office, Board Member of the UBA. Other participants included Vasyl Andrusyak, Board Member of the UBA Committee on Tax and Customs Law, Partner and Head of the Tax Law practice at MORIS, and Oksana Kharytonova, Counsel at KM Partners.
The discussion focused on several key topics, including:
- Non-enforcement of court rulings as a major challenge in tax disputes: from formalism to accountability.
- The state of cassation review of appeals and legal positions in current judicial practice.
- Creating an attractive investment climate in Ukraine: mechanisms for protecting investments through prosecutorial bodies and the role of administrative courts.
The roundtable organizers are confident that open dialogue between the business community, government officials, and the legal profession not only helps in understanding and resolving issues like the non-enforcement of court decisions, but also fosters the development of transparent and fair conditions for doing business.
