Lawyers Once Again Call to Stop IP Reform Blockade

KYIV - July 30, 2020. The UBA Committee on Intellectual Property appealed to the Prime Minister of Ukraine Denys Shmygal and the Minister of Economy, Trade and Agriculture of Ukraine Ihor Petrashko to stop blocking the reform of the state system of legal protection of intellectual property and finally complete it by providing rapid and transparent processes of creation of the National Intellectual Property Authority (NIPA).

The reason for the indignation of lawyers was the reappointment of Andriy Kudin to the position of General Director of Ukrpatent - in November 2019 he was fired for a number of gross violations of the law. Among them are systemic non-fulfillment of planned financial indicators, unreasonable increase in Kudin's labor costs, ineffective management decisions when acquiring assets, etc.

Experts of the UBA Committee reminded that Ukrpatent performs the main functions of the state system of legal protection of IP, and, therefore, plays a key role in its reform. In addition, a NIPA will be established on the basis of the institute - a relevant event provided by the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on the Establishment of a National Intellectual Property Authority", adopted by the Verkhovna Rada on June 16. Lawyers stressed that the IP community has been waiting for it for more than 5 years, since the adoption of the concept of reforming the relevant state system. The need for such reform is caused by the problems that have arisen precisely due to the unprofessional management of Ukrpatent.

However, despite the above, on July 22, Ukrpatent General Director Andriy Kudin was reinstated:

The perpetrators have not yet been held responsible for these violations. Due to the reinstatement of the Head of Ukrpatent, the professional community is concerned about the possible blocking of the reform and the completion of the formation of NIPA,” the text of the appeal reads.

We should remind that back in May, the UBA IP Committee has already appealed to Igor Petrashko to prevent the leadership of a key IP institution from openly blocking the implementation of the reform supported by the parliament.
