UBA & Supreme Court: Discussions Digest

KYIV - July 21, 2020. At the beginning of March, the Ukrainian Bar Association (UBA) promptly and with maximum benefit adapted to the quarantined restrictions, launching a series of webinars on the most topical issues. Among them is a joint project with the Supreme Court and the Association for the Development of Judicial Self-Development of Ukraine, dedicated to discussing the latest practice of the Supreme Court. 14 online meetings later, on the eve of a short break, we have gathered for you all links in one place.

Webinar 1. Judges Olena Kibenko and Vitaliy Urkevych spoke about determining the jurisdiction of corporate disputes and new approaches of the Supreme Court to resolving corporate disputes.

Webinar 2. Oleksandra Yanovska, Judge of the Grand Chamber of the Supreme Court, Doctor of Law, Professor, told the participants of the webinar about the principles of adversarial proceedings in the judicial practice of the Supreme Court and the peculiarities of its implementation at each stage.

Webinar 3. Vsevolod Knyazev, Secretary of the Grand Chamber of the Supreme Court, opened the topic of criteria for delimitation of judicial jurisdiction in the practice of the Supreme Court.

Webinar 4. Dmytro Hudyma, Judge of the Supreme Court, spoke about effective ways to protect rights and interests of citizens.

Webinar 5. The practice of the Commercial Court of Cassation in the Supreme Court on land disputes was discussed with Yurii Chumak, Judge of the Judicial Chamber for land relations and property rights of the Commercial Court of Cassation in the Supreme Court.

Webinar 6. Rasim Babanli, Head of the Department of Legal Analytical and Legal Work of the Supreme Court, Doctor of Laws, introduced the participants to the application of the case law of the European Court of Human Rights in national judicial practice in criminal proceedings.

Webinar 7 “Cassation Filters in Civil Law Cases”. Dmytro Luspenyk, Secretary of the Plenum of the Supreme Court, spoke about the pros and cons of recent legislative changes and the practice of European legislation.

Webinar 8 and one of the most relevant topics today - bankruptcy. Serhii Zhukov, Judge of the Judicial Chamber for Bankruptcy Cases of the Commercial Court of Cassation of the Supreme Court, considered case law in such cases and the available opportunities for the debtor and creditors.

Webinar 9. Volodymyr Kravchuk, Member of the Board of the Ukrainian Bar Association, Judge of the Supreme Court, delivered key nuances of judicial terms in administrative cases.

Webinar 10. Olga Stupak, Judge of the Civil Court of Cassation of the Supreme Court, presented the peculiarities of consideration of cases concerning the distribution of property of the spouses and their disposal.

Webinar 11. Given the record number of feedback and questions on the principles of administrative proceedings, the second online meeting with Volodymyr Kravchuk, Judge of the Administrative Court of Cassation of the Supreme Court, was organized.

Webinar 12. Ihor Olender, Judge of the Administrative Court of Cassation of the Supreme Court, answered the questions on evidence and proof in tax disputes.

Webinar 13. Nadiya Stefaniv, Judge of the Criminal Court of Cassation in the Supreme Court, told about procedural filters of cassation review of court decisions in criminal proceedings.

Webinar 14. Together with Vasyl Krat, Judge of the Civil Court of Cassation in the Supreme Court, we presented the topic of “invalidity” in judicial practice.

“Off screen”

During the online meetings with the judges of the Supreme Court, the participants had the opportunity to ask the speakers their questions and get first-hand answers. However, airtime is limited, so a significant number of questions were left out of the picture. We rectified the situation and started a series of materials with long-awaited answers.
